Please read these Terms carefully before using our mobile applications, website and related services (the “Services”).
1. Agreement to these Terms
These Terms of Use (“Terms”) are a legal agreement between you and the operator of My Funding Whizz (“we”, “us”, or “our”).
By downloading, installing, accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
We may offer additional terms for specific features; those terms apply in addition to these Terms where expressly stated.
2. About the Services
My Funding Whizz is a software platform that helps registered childminders and parents/guardians in the United Kingdom manage early-years childcare funding workflows, including:
• Creating and managing accounts for childminders and parents
• Recording child and family information needed for funding declarations
• Completing, reviewing and signing funding declaration forms
• Generating documents, such as PDFs, related to those declarations
• Purchasing and consuming credits to use certain declaration features for childminders
Important: We are a technology provider. We are not a Local Authority, government agency, regulator or tax adviser. We do not guarantee funding approval, payment amounts or compliance outcomes from any authority.
3. Eligibility
You may use the Services only if:
• You are at least 18 years old
• You have legal capacity to enter into a binding contract
• You are using the Services for lawful childcare funding administration in the United Kingdom, or another jurisdiction only where we expressly make the Services available
• You are a registered childminder, parent/guardian or other authorised user appropriate to your assigned role
• You are not barred from using the Services under applicable law
You must provide accurate registration information and keep it up to date.
4. Accounts and security
4.1 Registration
You must register for an account to use most features. You agree to provide truthful, complete information and to verify your email address when required.
4.2 Credentials
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@myfundingwhizz.co.uk if you suspect unauthorised access.
4.3 One role per account
Accounts are designed for a single primary role (childminder or parent) at a time, as implemented in the Services. You must not attempt to circumvent role restrictions.
4.4 Account deletion
You may request account closure or data deletion as described in our Privacy Policy. Deletion may be limited where we must retain certain records for legal, billing or security reasons.
5. User roles
5.1 Childminders
Childminders may create and manage declarations, invite parents, maintain child records they are authorised to manage and purchase credits where applicable. You represent that you are appropriately registered or authorised to act as a childminder in your jurisdiction.
5.2 Parents and guardians
Parents may review, complete or approve declaration steps assigned to them via invitation or linked accounts. You represent that you have parental responsibility or lawful authority for any child information you provide or approve.
5.3 Collaboration
Information you share with another user through the Services, for example via parent invitations, may become visible to that user within the platform. You are responsible for sharing data only with appropriate recipients.
6. Credits and payments
6.1 Credits
Certain declaration features consume credits purchased by childminders. Credit balances, pricing and usage rules are displayed in the app and may change from time to time with reasonable notice where required.
6.2 Payments via Stripe
Credit purchases are processed by Stripe. By completing a purchase, you also agree to Stripe’s applicable terms and privacy policy. We do not store your full payment card details.
6.3 Refunds
Except where required by applicable consumer law, credit purchases are generally non-refundable once credits have been added to your account or used. If you believe a charge was made in error, contact support@myfundingwhizz.co.uk within 14 days with your transaction details.
6.4 Taxes
Prices may be shown inclusive or exclusive of VAT as indicated at checkout. You are responsible for any taxes not collected by us where applicable.
7. Declarations and records
7.1 Your responsibility for accuracy
You are solely responsible for the accuracy, completeness and timeliness of information entered into declarations, including hours, dates, child details and signatures. The Services provide tools to assist you; they do not replace your professional judgement or statutory obligations.
7.2 Submissions to authorities
Unless we expressly state otherwise, submitting data to a Local Authority or funding body is your responsibility. Export, email or portal submission outside the app may be required depending on your Local Authority’s process.
7.3 Electronic signatures
Where you apply an electronic signature in the app, you intend to sign the relevant document and agree that your signature may be stored and included in generated PDFs or records associated with the declaration workflow.
7.4 Local drafts
Draft data may be stored locally on your device until you submit it. You are responsible for backing up important information and for device security
8. Acceptable use
You agree not to:
• Use the Services for any unlawful, fraudulent or misleading purpose
• Upload false, defamatory or infringing content
• Access or attempt to access another user’s account or data without authorisation
• Reverse engineer, decompile or scrape the Services except where permitted by law
• Interfere with or disrupt the Services, servers or networks
• Circumvent credit, authentication or security controls
• Use automated means to access the Services without our written consent
• Process personal data you are not authorised to process, including children’s data without proper authority
We may investigate violations and cooperate with law enforcement where appropriate.
9. Intellectual property
The Services, including software, design, text, graphics, logos and documentation (excluding your content), are owned by us or our licensors and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your internal business or personal childcare funding administration, in accordance with these Terms.
You retain ownership of content you submit. You grant us a licence to host, process, display and transmit your content solely to operate and improve the Services.
10. Third-party services
The Services integrate with third parties such as Stripe (payments) and Google Firebase (push notifications). Your use of those features may be subject to additional third-party terms. We are not responsible for third-party services we do not control.
Links to external websites are provided for convenience only. We do not endorse and are not responsible for external content.
11. Privacy
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read the Privacy Policy.
12. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
We do not warrant that the Services will be uninterrupted, error-free, secure or free of harmful components, or that declarations prepared using the Services will be accepted by any Local Authority or funding body.
Nothing in these Terms excludes or limits warranties that cannot be excluded under the Consumer Rights Act 2015 or other mandatory UK consumer protection laws applicable to you.
13. Limitation of liability
Subject to section 13.3:
• We are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill
• Our total aggregate liability arising out of or relating to the Services or these Terms shall not exceed the greater of (a) the amounts you paid us for credits in the twelve (12) months before the claim, or (b) one hundred pounds sterling (£100)
13.3 Exceptions
Nothing in these Terms limits or excludes liability for:
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be limited or excluded under applicable law
If you use the Services as a consumer, you benefit from mandatory statutory rights and nothing in these Terms affects those rights.
14. Indemnity
If you use the Services in a business capacity, you agree to indemnify and hold us harmless against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services or infringement of third-party rights, except to the extent caused by our negligence or wilful misconduct.
15. Suspension and termination
We may suspend or terminate your access to the Services immediately if you breach these Terms, pose a security risk or if we are required to do so by law.
You may stop using the Services at any time. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and governing law, will survive.
16. Changes to these Terms
We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Where changes are material, we will provide reasonable notice through the app or by email.
Your continued use after the effective date of revised Terms constitutes acceptance, except where your express consent is required by law.
17. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.
If you are a consumer resident in Scotland or Northern Ireland, you may also benefit from mandatory protections in your home jurisdiction.
Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers may bring proceedings in the courts of their country of residence where required by law.
